Welcome to Niftycycles! These Terms and Conditions (“Terms”) govern your use of our website, products, services, and subscriptions relating to proprietary TradingView indicators (“Indicators”). By accessing or using our services, you agree to these Terms.
1. Introduction
1.1. These Terms apply to all users (“you”, “your”, “Subscriber”) of the website niftycycles.in, mobile applications, and any associated services offered by Niftycycles (“we”, “us”, “our”).
1.2. By subscribing, accessing, or downloading our Indicators, you agree to be bound by these Terms, including any additional terms referenced herein.
2. Definitions
Subscriber/User: Any individual or entity that registers for or uses the service.
Indicator: A proprietary technical analysis tool developed for use on TradingView.
Subscription: Paid access to the Indicator and associated materials.
Content: Documentation, guides, videos, code, screenshots, and other materials provided.
3. Eligibility
3.1. You must be at least 18 years old and capable of entering into a binding contract.
3.2. By using our services, you represent that you have the legal capacity to enter into these Terms.
3.3. If using on behalf of a company, you represent you are authorized to bind that company.
4. Account Creation
4.1. To access the Indicator, you must create an account with a valid email and password.
4.2. You agree to provide accurate information and keep your account secure.
4.3. You are responsible for all activity under your account.
5. Subscription & Payment
5.1. Access to the Indicator is through paid subscription only. Free trials may be offered at our discretion.
5.2. All fees are stated in USD and INR and are non-refundable except where required by law.
5.3. Payment is processed through third-party payment gateways; we are not responsible for issues with your bank or payment provider.
5.4. We reserve the right to change prices; changes affect only new subscriptions.
6. License and Intellectual Property
6.1. We grant you a non-exclusive, non-transferable, revocable license to use the Indicator for personal or internal business purposes.
6.2. You do not own the Indicator code, scripts, documentation, or underlying intellectual property.
6.3. You may not:
Copy, modify, sell, redistribute, sublicense, or create derivative works.
Reverse-engineer or extract source code.
6.4. TradingView™ and related logos are trademarks of their respective owners. We are not affiliated with or endorsed by TradingView, Inc.
7. Use of the Indicator
7.1. The Indicator is provided for educational and informational purposes only.
7.2. We do not provide financial, investment, legal, or tax advice. You agree to consult professionals for such advice.
7.3. Your trading decisions are your own; we are not liable for trading losses or profits.
8. Restrictions
You shall not:
8.1. Use the Indicator for unlawful purposes.
8.2. Share access with non-paying users.
8.3. Engage in unauthorized copying, distribution, or public display.
9. Refund and Cancellation Policy
9.1. Refunds are processed only if required by applicable law or at our discretion (e.g., fraudulent charges).

9.3. No refunds will be provided for partial subscription periods already consumed.
10. Privacy and Data Protection

10.2. By using our services, you consent to the collection and processing of your information as per the Privacy Policy.

11. Termination

11.2. Upon termination, your access to Indicators and content will cease.
12. Disclaimers

12.2. We do not warrant uninterrupted or error-free service.
12.3. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
13. Limitation of Liability
13.1. To the fullest extent permitted by law, we are not liable for:
Direct, indirect, incidental, consequential damages.
Loss of profits, data, or reputation.
13.2. Maximum liability shall not exceed the amount you paid in the last 12 months.
14. Indemnification
